DEFINITION

“The Company” shall mean, My iStick trading name of iFLY7 Limited (“iFLY7 Limited”, “us”, “we” or “our”) are registered inEngland and Wales with Company number 9237063. VAT Reg No: GB209311733
Conforms to the Distance Selling Regulations Act and Sale of Goods Act 1979. Your statutory rights are not affected

PERSONAL INFORMATION

The Company takes security of your personal information very seriously. To ensure your details and payments are 100% safe, we use a secure server with industry standard encryption methods to maintain the safety of your personal and confidential information. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

What information do we collect?
We collect information from you when you register on the site, place an order, enter a competition or respond to a survey or communication such as e-mail, or participate in another site feature.
We also collect information about gift recipients so that we can fulfil the gift purchase. The information we collect about gift recipients is not used for marketing purposes.
The Company will not share your information with any third parties unless given permission.

Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these linked sites (including if a specific link does not work). If we decide to change our privacy policy, we will post those changes onto the Terms & Conditions page. Policy changes will apply only to information collected after the date of the change. By using our site, you consent to our privacy policy.

PRODUCTS

All products are available while stocks last, if we are unable to supply a product to you following our acceptance of your order and payment, you will be notified as soon as possible and payment will be refunded.
If you Pre-order a product, you will be notified by email when the product will be due to be dispatched. We have made every effort to display the images accurately.The Company reserves the right to revise and/or discontinue products at any time without notice. Revised or updated products may differ but will have the functionality and performance of the products ordered. As the customer, you acknowledge and accept that the specification of products delivered to customer may differ from the specification of products ordered.

PAYMENT

Payment for the products shall be made in full before delivery. You must ensure that you provide full and accurate payment details e.g. credit or debit card and delivery
address at the point of submitting your order. We currently accept the following methods of payment:- VISA, MasterCard, Visa Electron or PayPal payments through our eBay store. 

DELIVERY

Orders placed before 3pm Mon-Thu will be shipped the same working day. Note: Orders placed after this deadline will be shipped the next available working day. The Company will endeavour to deliver your Product/s by the estimated delivery date set out in the acceptance email. In the case of pre-ordered Products, an advisory confirmation email will be sent with the estimated delivery date. If we are unable to meet the estimated delivery date because of an event outside our reasonable control we will email to you a revised estimated delivery date. Delivery is deemed as fulfilled when the products arrives at the address given in the order by the customer.
You will be notified of the delivery charges when you place your order. Delivery outside the EU may be subject to local import duties, custom duties or taxes which are the responsibility of the customer where they apply. Unfortunately we cannot advise you what these charges are and we will not be responsible for these charges. Please note that if no payment is made of these local import/custom duties or taxes then the product
could be returned or destroyed. In this instance, we may not be able to refund your purchase.

CANCELLING OR AMENDING ORDERS

Should the Customer need to cancel or amend an order please email The Company immediately. Unfortunately once a product(s) has left the premises, they cannot be recalled.

RETURNS POLICY

Please note that returns are not able to be accepted in person at our registered office address. If a Customer is not satisfied with the product, we ask that you contact The Company to obtain a Return Delivery Note within 14 calendar days of the receipt of the product. The Customer must then return the product within 14 calendar days of the issuance of the Return Delivery Note.  Goods will not be accepted without a Return Delivery Note. In some cases, it may not be necessary to return faulty products if you are able to evidence photographic support via email to support@myistick.co.uk

Should you believe that the Product/s are faulty please do not hesitate to contact us. If we are unable to assist, we may ask you to return the goods. If, upon receipt it is deemed that the product is damaged due to inappropriate use or accident it will be excluded from any guarantee and no refund will be offered. The goods MUST be returned to The Company in their original condition with ALL packaging in good order including any
accessories, manuals, documentation and registration information within 14 days. The warranty on the product is 12 months from date of order. We recommend that the Customer DOES NOT ACCEPT DELIVERY from the carrier If the packaging or product arrives damaged. If the Customer accepts the goods, please make sure it is noted on the carrier's delivery record in order for us to file a damage claim. The Customer must save the product AND the original box and packing it arrived in and notify us immediately. If the product is faulty and the Customer does not notify us of damaged goods within the first 14 days of arrival no refund will be offered.
If the customer is asked to return any product(s) to The Company,

  1. You MUST use recorded delivery or a carrier that offers tracking for your return as The Company cannot be liable for items sent back by the Customer.
  2. The Customer MUST retain proof of return, or a tracking number if sent by courier.
  3. Should the Customer not be able to provide proof of return, The Company reserves the right not to issue a refund of any description or replace the product(s)

Please note that the Customer will be responsible for the cost of returning product(s) and ensuring that items are packaged correctly when returning as no refund will be offered on any product(s) damaged due to poor packaging.

The Company will provide an exchange or offer a refund based on Customer original method of payment, handling and return postage charges will not be refunded. A refund payment or replacements will be made within 30 days or earlier once we have inspected the returned product and are satisfied that it has been returned to us in the condition required.

We reserve the rights to refuse any returns that:
(a) Have been specified as not be refundable once item package has been opened;
(b) Is not returned in its original packaging;
(c) Has missing part;
(d) Return is received beyond 14 calendar days from the original Return Code date.

If, upon receipt it is deemed that the Product is not be faulty, you will not be refunded. Damage due to inappropriate use or accident are specifically excluded from any guarantee. You may only transfer your rights or our obligations under these Terms to another person if we agree in writing. However if you have purchased a product as a gift, you may transfer the benefit of any warranties we give to you under this contract to the recipient of the gift without needing to ask our consent. This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. These Terms are governed by English law. This means a contract for the purchase of Products through The Company and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

ACCEPTANCE OF PRODUCTS

The Products shall be deemed to have been accepted by the Customer as being in good condition and in accordance with the Contract, unless the Customer notifies The Company to the contrary on the day of delivery, such notification is confirmed in writing within two days.

ORDERS & PRICES

Unless otherwise stated, The Company prices do not include import or export fees, duties, tariffs or other charges. Any such charge will be shown in the Invoices where applicable. All costs incurred for shipping and handling will be borne by Customer. All prices quoted in writing are valid for the period specified on the quotation-Invoice or until earlier acceptance by Customer.
All Prices are in GB £ (pounds sterling) Goods are charged at the price shown on the product pages on the date/time of an order and are inclusive of VAT. Prices are correct at the time of publication. Errors and omissions are excepted. Should product/s be listed at an incorrect price, The Company reserves the right to retract the Product/s from sale and refund the Customer in full. 

SHIPPING AND DELIVERY

The Company shall deliver the Products to the place of delivery designated by Customer as evidenced in Customer's invoice. The Company may deliver Products by instalments in any sequence. In such case, each instalment shall be treated as a separate contract and no default or failure in respect of any one or more instalments shall vitiate the Contract in respect of products previously delivered or undelivered Products. Any delivery dates quoted, are approximate and shall not form part of the Contract. We shall endeavour to meet the delivery date but will not be liable for any delay in delivery of the Products, howsoever caused. Should the Customer fail to take delivery of the product(s) or any part of them tendered in instalment’s, or fails to provide any instructions to enable us to make delivery on the due date, delivery shall be deemed to have taken place and My iStick
shall be entitled, upon giving written notice to Customer, to store or arrange for storage of the Products, whereupon risk in the Products shall pass to Customer, the Customer shall be eligible to pay MyiStick for all costs and expenses (including storage and insurance charges) arising from its failure-refusal. Rescheduling of delivery, change or cancellation of orders are all subjected to Administrative charges as shall be determined by The Company.

GENERAL INFORMATION

The Company may revise Terms & Conditions from time to time, any changes to our Terms & Conditions will be notified on the website. You must check these whenever you place an order with us.

FORCE MAJEURE

Neither party shall be liable for any delay in performing any of its obligations under these Terms and Conditions, if such delay is caused by circumstances beyond the reasonable control of the party, a reasonable extension of time for the performance of such obligations shall be permitted.

PROMOTIONAL VOUCHER CODE TERMS

From time to time you may receive a promotional voucher from us; only one such promotional voucher code can be redeemed per order. We reserve the right to cancel promotional voucher codes at any time without notice and without giving a reason. Promotional voucher codes cannot be re-used. Promotional voucher codes and are not transferable. Promotional voucher codes may not be used in conjunction with any other offer, discount or promotion. Promotional codes cannot be applied retrospectively or to existing orders. Promotional voucher codes may not be sold. For the avoidance of doubt, this includes auctions and other online sales. Certain Products cannot be purchased with promotional voucher codes. Such Products are clearly marked on their respective Product pages.

THE COMPANY RESPONSIBILITIES

The Company has tried to ensure that descriptions (including all pictures) of the Products are as accurate as possible. Products ordered will be insured at their retail value by The Company whilst being delivered to you. We will not cover any subsequent loss or destruction following fulfilment/delivery of the order. All notices sent by email will be deemed to have been received on the day that they are sent. All notices sent by post will
be deemed to have been received 3 working days after the date of posting. Our website may contain links to other Retailers websites, these links are provided for your convenience only and we are not responsible for the content of those sites. Please ensure that you read the Terms & Conditions on the third party sites as they may differ to those of The Company.

THE COMPANY LIABILITIES

Our Products are supplied for domestic and private use. You agree not to use the Product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Please read the instructions, manuals and other user documentation that comes with your Products carefully. The Company is not involved in the manufacture of Products. We recommend that you use all Products safely and with care and in accordance with the manufacturer’s guidelines. Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

My iStick is a trading name of iFLY7 Ltd. The copyright, design, look and content of the website, all photographs, marketing and other intellectual property rights within the website or software accessed via the website are owned by or licensed by The Company and, unless otherwise specified, may not be used, copied or altered without our express consent. The logos and domain names are trade names or trademarks of iFLY7 Ltd and My iStick may not be used by anyone else without our express permission. We do not authorise (unless express permission is given) right or interest in any copyright or intellectual property rights in any Product nor the right to copy them.
